  1. BY CLICKING ON THE "ACCEPT" BUTTON OR OPENING THE PACKAGE, YOU ARE

  7. CRYSTAL DOWNLOAD END USER LICENSE AGREEMENT
  8. REDISTRIBUTION NOT PERMITTED
  9.  
  10. Crystal grants you a non-exclusive license to use the Software free
  11. of charge if (a) you are a student, faculty member or staff member of
  12. an educational institution (K-12, junior college, college or library)
  13. or an employee of an organization which meets Crystal's criteria for
  14. a charitable non-profit organization; or (b) your use of the Software
  15. is for the purpose of evaluating whether to purchase an ongoing
  16. license to the Software.  The evaluation period for use by or on
  17. behalf of a commercial entity is limited to 90 days; evaluation use by
  18. others is not subject to this 90 day limit.  Government agencies
  19. (other than public libraries) are not considered educational or
  20. charitable non-profit organizations for purposes of this Agreement. If
  21. you are using the Software free of charge, you are not entitled to
  22. hard-copy documentation, support or telephone assistance.  If you fit
  23. within the description above, you may use the Software in the manner
  24. described in Part III below under "Scope of Grant."
  25.  
  26. DISCLAIMER OF WARRANTY.
  27.  
  28. Free of charge Software is provided on an "AS IS" basis, without
  29. warranty of any kind, including without limitation the warranties of
  30. merchantability, fitness for a particular purpose and
  31. non-infringement. The entire risk as to the quality and performance of
  32. the Software is borne by you.  Should the Software prove defective,
  33. you and not Crystal assume the entire cost of any service and
  34. repair. In addition, the security mechanisms implemented by Crystal
  35. software have inherent limitations, and you must determine that the
  36. Software sufficiently meets your requirements. This disclaimer of
  37. warranty constitutes an essential part of the agreement. SOME
  38. JURISDICTIONS DO NOT ALLOW EXCLUSIONS OF AN IMPLIED WARRANTY, SO THIS
  39. DISCLAIMER MAY NOT APPLY TO YOU AND YOU MAY HAVE OTHER LEGAL RIGHTS
  40. THAT VARY BY JURISDICTION.

  42. SCOPE OF GRANT.
  43.  
  44. You may:
  45. * use the Software on any single computer;
  46. * use the Software on a network, provided that each person accessing
  47.   the Software through the network must have a copy licensed to that
  48.   person;
  49. * use the Software on a second computer so long as only one copy is
  50.   used at a time;
  51. * copy the Software for archival purposes, provided any copy
  52.   must contain all of the original Software's proprietary notices; or
  53. * if you have purchased licenses for a 10 Pack or a 50 Pack, make up
  54.   to 10 or 50 copies, respectively, of the Software (but not the
  55.   Documentation), provided any copy must contain all of the original
  56.   Software's proprietary notices.  The number of copies is the total
  57.   number of copies that may be made for all platforms.  Additional
  58.   copies of Documentation may be purchased.

  60. You may not:
  61. * permit other individuals to use the Software except under the terms
  62.   listed above;
  63. * permit concurrent use of the Software;
  64. * modify, translate, reverse engineer, decompile, disassemble
  65.   (except to the extent applicable laws specifically prohibit such
  66.   restriction), or create derivative works based on the Software;
  67. * copy the Software other than as specified above;
  68. * rent, lease, grant a security interest in, or otherwise transfer
  69.   rights to the Software; or
  70. * remove any proprietary  notices or labels on the Software.
  71.  
  72. TITLE.

  74. Title, ownership rights, and intellectual property rights in the
  75. Software shall remain in Crystal and/or its suppliers. The Software
  76. is protected by the copyright laws and treaties.  Title and related
  77. rights in the content accessed through the Software is the property of
  78. the applicable content owner and may be protected by applicable
  79. law. This License gives you no rights to such content.
  80.  
  81. TERMINATION.
  82.  
  83. The license will terminate automatically if you fail to comply with
  84. the limitations described herein.  On termination, you must destroy
  85. all copies of the Software and Documentation.
  86.  
  87. EXPORT CONTROLS.
  88.  
  89. None of the Software or underlying information or technology may be
  90. downloaded or otherwise exported or reexported (i) into (or to a
  91. national or resident of) Cuba, Iraq, Libya, Yugoslavia, North Korea,
  92. Iran, Syria or any other country to which the U.S. has embargoed
  93. goods; or (ii) to anyone on the U.S. Treasury Department's list of
  94. Specially Designated Nationals or the U.S. Commerce Department's Table
  95. of Denial Orders. By downloading or using the Software, you are
  96. agreeing to the foregoing and you are representing and warranting that
  97. you are not located in, under the control of, or a national or
  98. resident of any such country or on any such list.
  99.  
  100. In addition, if the licensed Software is identified as a
  101. not-for-export product (for example, on the box, media or in the
  102. installation process), then the following applies: EXCEPT FOR EXPORT
  103. TO CANADA FOR USE IN CANADA BY CANADIAN CITIZENS, THE SOFTWARE AND ANY
  104. UNDERLYING TECHNOLOGY MAY NOT BE EXPORTED OUTSIDE THE UNITED STATES OR
  105. TO ANY FOREIGN ENTITY OR "FOREIGN PERSON" AS DEFINED BY
  106. U.S. GOVERNMENT REGULATIONS, INCLUDING WITHOUT LIMITATION, ANYONE WHO
  107. IS NOT A CITIZEN, NATIONAL OR LAWFUL PERMANENT RESIDENT OF THE UNITED
  108. STATES.  BY DOWNLOADING OR USING THE SOFTWARE, YOU ARE AGREEING TO THE
  109. FOREGOING AND YOU ARE WARRANTING THAT YOU ARE NOT A "FOREIGN PERSON"
  110. OR UNDER THE CONTROL OF A FOREIGN PERSON.

  112. LIMITATION OF LIABILITY. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL
  113. THEORY, TORT, CONTRACT, OR OTHERWISE, SHALL CRYSTAL OR ITS SUPPLIERS
  114. OR RESELLERS BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT,
  115. SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER
  116. INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK
  117. STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER
  118. COMMERCIAL DAMAGES OR LOSSES. IN NO EVENT WILL CRYSTAL BE LIABLE FOR
  119. ANY DAMAGES IN EXCESS OF THE AMOUNT CRYSTAL RECEIVED FROM YOU FOR A
  120. LICENSE TO THE SOFTWARE, EVEN IF CRYSTAL SHALL HAVE BEEN INFORMED OF
  121. THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER
  122. PARTY. THIS LIMITATION OF LIABILITY SHALL NOT APPLY TO LIABILITY FOR
  123. DEATH OR PERSONAL INJURY TO THE EXTENT APPLICABLE LAW PROHIBITS SUCH
  124. LIMITATION. FURTHERMORE, SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION
  125. OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS
  126. LIMITATION AND EXCLUSION MAY NOT APPLY TO YOU.

  128. HIGH RISK ACTIVITIES.

  130. The Software is not fault-tolerant and is not designed, manufactured
  131. or intended for use or resale as on-line control equipment in
  132. hazardous environments requiring fail-safe performance, such as in the
  133. operation of nuclear facilities, aircraft navigation or communication
  134. systems, air traffic control, direct life support machines, or weapons
  135. systems, in which the failure of the Software could lead directly to
  136. death, personal injury, or severe physical or environmental damage
  137. ("High Risk Activities").  Crystal and its suppliers specifically
  138. disclaim any express or implied warranty of fitness for High Risk
  139. Activities.

  141. MISCELLANEOUS.
  142.  
  143. If the copy of the Software you received was accompanied by a printed
  144. or other form of "hard-copy" End User License Agreement whose terms
  145. vary from this Agreement, then the hard-copy End User License
  146. Agreement governs your use of the Software.  This Agreement represents
  147. the complete agreement concerning this license and may amended only by
  148. a writing executed by both parties. THE ACCEPTANCE OF ANY PURCHASE
  149. ORDER PLACED BY YOU IS EXPRESSLY MADE CONDITIONAL ON YOUR ASSENT TO
  150. THE TERMS SET FORTH HEREIN, AND NOT THOSE IN YOUR PURCHASE ORDER. If
  151. any provision of this Agreement is held to be unenforceable, such
  152. provision shall be reformed only to the extent necessary to make it
  153. enforceable.  This Agreement shall be governed by California law
  154. (except for conflict of law provisions). The application the United
  155. Nations Convention of Contracts for the International Sale of Goods is
  156. expressly excluded.
  157.  
  158. U.S. GOVERNMENT RESTRICTED RIGHTS.  Use, duplication or disclosure by
  159. the Government is subject to restrictions set forth in subparagraphs
  160. (a) through (d) of the Commercial Computer-Restricted Rights clause at
  161. FAR 52.227-19 when applicable, or in subparagraph (c)(1)(ii) of the
  162. Rights in Technical Data and Computer Software clause at DFARS
  163. 252.227-7013, or at 252.211-7015, or to Crystal's standard commercial
  164. license, as applicable, and in similar clauses in the NASA FAR
